TERMS & CONDITIONS


Once a job has been confirmed between agency and client a booking confirmation form will be provided. This form must be read and signed and returned in order to go forward with said booking. Suzette Brissett Creatives are unable to secure talents without the above. There is no responsibility for loss of talent availability without said booking confirmation form.


The combination of the submitted form with terms and conditions shall form the agreement between client and agency for each individual booking. Any amendments made to the booking confirmation by the client shall not be valid and binding unless the agency has agreed to such amendment and/or variation in advance and confirmed such agreement by the agency.


1. Working Hours


Means the following, as the contact requires:


  1. Full Day Rehearsal - The working day shall consist of 8 hours of which one hour will be free of all work. The Talent will also be entitled to two additional fifteen minute breaks.
  2. Half Day Rehearsal - The working day shall consist of 4 hours of which twenty minutes will be free of all work.
  3. Live Show / Shoot Day - The working day shall consist of ten hours of which one hour shall be free of all work. The Talent will also be entitled to two fifteen minute breaks; and.
  4. Overnight Gap - You must provide Talent/ Creative with an overnight gat of not less 12 hours between call times. If this provision is breached, we shall be entitled to make a penalty payment at the relevant Overtime Rate.
  5. Dawn Call Times - If you require Talent/ Creative to be called at or before 7:30am for a live performance or music video we shall be entitled to charge you overtime at the relevant Overtime Rate.

2. Overtime Rates


Means the following as the context requires unless otherwise set out in the Booking confirmation:


  1. Rehearsal - During rehearsal, any hours beyond 8 hours shall be chargeable at the rate of 20% of the daily fee paid per hour.
  2. Live Shows - During Live Shows and Shoot Day, by prior agreement, hours beyond 10 hours will be charged at 20% of the daily fee paid per hour.
  3. Overnight Work - Any hours worked beyond 14 hours of work or after midnight, shall be charged at the rate of 30% of the daily fee paid per hour.
  4. Overnight Break Penalty - In the event of a breach of the Overnight Break Penalty, you will be charged at the rate 20% of the daily fee per hour.
  5. Night Work - Any work scheduled from 4:30pm and due to extend beyond midnight shall only be carried out prior arrangement and at an agreed rate.

3. Holiday Pay


  1. An additional 12.07% of the total daily fee(s) will be calculated and invoiced at the end of the contract period if paid holiday is not given.
  2. For the avoidance of doubt, and in accordance with statutory obligations, a dancer must receive holiday pay for all engagements if paid time off is not given. Holiday pay cannot be 'rolled up' as a part of the daily fee and must be clearly itemised on all pay slips.

4. Breaks - Music Videos and Other Live Work


  1. Meal Break - In the event that for any reason a main meal break is curtailed, or delayed by more that 30 minutes, a penalty payment will be charged at one hour at the relevant Overtime Rate.
  2. Provision Of Meals - Shoot / Show Day - You shall provide Talent/ Creative with for food sufficient to provide three full meals (catered to the dietary requirements of the Talent) to be provided per Shoot, Show Day, together with other suitable beverages / light refreshments.

5. Travel Time


  1. Talents are booked as 'local' to London, M25 Surrounding areas, unless otherwise agreed. Travel time within 20 miles of Charing Cross Station to the rehearsal/production/performance venue will not be calculated as Working Time.
  2. Where the Talent/ Creative is required to travel to or from rehearsal/production/performance venue more that 20 miles from Charing Cross, the necessary travel time to and from the venue shall be calculated from Charing Cross and included in Working Hours.
  3. Where International travel is required on a working day (fitting, rehearsal, show/shoot), Working Hours will be calculated from flight departure time.
  4. Where travel to or from a location is required on a day when no further services are required a sum will be paid at no less than the half show day rate and the other terns of this agreement apply.
  5. For long-haul flights, defined as 8 hours or more for the purpose of these conditions, a seat in premium economy will be requested. Where this is not possible, 24 hours paid rest to be scheduled before work is required.
  6. Sleeper bus is classed as accommodation not travel. For avoidance of doubt, in the event that travel by sleeper bus occurs during the day, usually travel provisions will apply.

6. Conditions of Work


  1. Changing Area - A Private single-sex changing area / room will be provided for use be the Talent. If this is not possible a partition will be provided or separate use times scheduled.
  2. Bathroom Facilities - The Talent require access to adequate bathroom facilities.
  3. Temperature - At all times consideration will be given to what the Talent is required to wear and temperatures will be adjusted accordingly. Guidelines suggest that the temperature in rehearsal rooms should not drop below 18 degrees centigrade or rise above 24 degrees centigrade. The rehearsal rooms or shoot / performance location will be kept well ventilated.
  4. Floor and Equipment - You shall notify us immediately regarding any hazardous conditions. Talents performing on concrete is always considered hazardous. Please contact us prior to rehearsal or shoot for complete hazard list or for any questionable conditions.
  5. Drinking Water - Fresh drinking water shall be made available to the Talent for the duration of the Shoot / Show Day.
  6. Wardrobe - The Talent shall be compensated for items of their clothing they are required to wear for a shoot / live performance, this must be pre-agreed with the agency. £50 per item or £75 for an en tire outfit up to 3 items.
  7. If the Talent are provided with costumes which are to be used for multiple performance over a number of days, the costumes are required to be cleaned after each day.
  8. Fitting - If fittings are required within the UK outside of the Talent's normal hours of work, a payment will be made of £50 forum to 2 hours and £50 per hour thereafter.
  9. International and European Fitting - If Talent are required on Projects on days where no other services are required of the Talent, they will be paid 50% of the agreed day fee provided such fittings do not exceed 4 hours in length.
  10. Free Day/s - The Talent is entitled to 2 days free of all calls in every district 14 day period. If a free day is breached, work on the free day will be paid at double time.
  11. Under no circumstances shall a Talent be required to work more that 13 consecutive days.

7. Accommodation


If the Talents/ Creative is on tour or temporarily required to relocate, single occupancy accommodation and breakfast of a good standard, three stars and above, must be provided for them.


8. Other Allowances


  1. Relocation - If Talent is temporarily required to relocate more than 20 miles from Charing Cross or on tour, the Talent / Creative shall receive per diems or adequate meal allowances. For work overseas, Talent will be paid per diems, not below the current Equity Overseas Touring Agreement Rates.
  2. Per Diems - Must be paid to the Talent in advance of the Project either in car or by BACS transfer.
  3. Anti-social working hours - Transport - For work continuing after 11pm, or commencing before or/at 7:30am, a taxi will be provided to the dancers' home or temporary address within M25 and surrounding areas of M25.

9. Your Obligations


  1. Warm Up / Cool Down - For shoot/ performance days, you are required to provide Talent with a fifteen minute up period including within Working Hours and provide a space for Talent to carry out fifteen minute cool down outside of Working Hours.
  2. Rehearsals - For rehearsals, you are required to provide a space for the Talent to carry out a fifteen minute warm up and cool down outside of the Working Hours.
  3. The Talent is entitled to two days free of all calls in every distinct 14 day period. If a free day is breached, work on the free day will be paid at double time.
  4. Any calls you make for fittings, makeup or hair shall count as Working Hours
  5. If you require Talent to be called at or before 7:30am for a live performance or music video, we shall be entitled to charge you overtime at the relevant Overtime Rate.

10. Permitted Use - Recorded Media


  1. The daily fee covers a rehearsal or live performance only and does not entitle you to record any performance other than for private use. Additional usage fee must be negotiated with us for the recording, televised/theatrical broadcasting of the permanence in the UK/US and or rest of the work for commercial or promotional purpose and its subsequent broadcasting, distribution or advertisement through other media channels, which will be charged at rates not less than Equity Agreement where they apply.
  2. If you wish rehearsals to be filmed for the purpose of any of the above names uses, additional usage fees must be negotiated in advance.
  3. No additional usage may be made without our permission and for an additional fee as mutually agreed.
  4. We reserve the right not to negotiate any extensions of use beyond the Permitted Use.

11. Live Shows


For live shows, if the Talent has changed of venue or client, this will be separate performance fee. If the Talent is booked for multiple performances in the same venue or for the same client, an increased fee will apply for a 10 hour day.


12. Confirmation Booking


  1. The Agent must be supplied with all information concerning the booking. This includes details of the Engager and full details of the engagement (schedule, and location details).
  2. The Agent must be informed of the call time at least 12 hours in advance of the proposed call time, where this information is available.
  3. Confirmation of the booking forms a binding contract and all sections of this agreement apply.

13. Cancellations


The cancellation fees shall apply if you wish a Talent/ Creative after a booking has been confirmed.


  1. If a booking is cancelled within 48 hours of the booking call time the full daily fee will be charged and payable by you, excluding any buyouts.
  2. Outside of the 48 hour period, bookings of 1-3 days length will be charged and payable by you at half of the daily rate, excluding any buyout.
  3. The full booking will charged and payable by the client for cancelled bookings of more than 3 days duration within a period equal to or less than the length of the booking.

14. Force Majeure


Neither Party to these Terms and Conditions shall be liable for any failure or delay in performing their obligations where such failure or delay results from any cause that is beyond the reasonable control of that Party. Such causes included, but are not limited to: power failure, Internet Services Provider failure, industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action or any other event that is beyond the control of the Party in question.


15. Health and Safety and Insurance


You are responsible for all aspect of health and safety os studio/ rehearsal room or location, and all risk assessment must be taken of location, equipment, work conditions and what is required of the Talent. Your employer's liability insurance must be in place, together with any other pessary insurance. Certification will be available at ay time the Talent/ Creative on request via us. You are obliged to me are that all other people engaged in connection with the booking and associated travelling are properly qualified and insured.


16. Specialist Skills


The following are deemed as 'specialist skills' and warrant an additional fee if required of the Talent: Sports/ Extreme:


  1. Tricks, head spins, knee work, throws.
  2. Aerial acrobatics and flying.
  3. Breakdancing, aerial acrobatics, skateboarding, roller skating and more.

17. Hazardous Duties


If there is any significant risk revealed during the process of risk assessment, such risk must be raised with us before he booking takes place. For avoidance of doubt these risks may include:


  1. Dancing performing on surfaces not fit for purpose including: concrete, carpet, raked stages, slippery surface including locations subject to inclement weather;
  2. A Talent's close proximity to special effects such as: fire, dangerous objects and pyrotechnic devices. Please note, this list not exhaustive. It is your responsibly to identify any further significant risks that could pose a risk to the Talent to mitigate against these.
  3. If a Talent is required to rehearse or perform on concrete, actual dancing hours may be no longer than 4 hours.
  4. If hazards are identified, it is your duty to ensure that proper assessments of the Talent's health are made during the course of, and at the end of the engagement and that any aftercare including physio is provided free of charge if deemed necessary.

18. Nudity / Semi Nudity


  1. In respect of any engagement in which there is nudity/semi nudity we must be informed in writing of this fact as well as the general nature and extent of such unity in the Book Request. The Talent's explicitly written consent must also be obtained in advance of contracts being entered into.
  2. For the sake of clarity “nudity”, “semi-nudity” shall man “to be in a state of undress which if in public could be regards as indecent.
  3. You will provide us with details of the role that you wish to fill. The details shall include the type of work required; the commencement date; duration; hours; and location. In the event that working hours are to exceed 48 hours per week at any given time. You must inform us prior to such work being undertaken.
  4. You must inform us of any health and safety risks or requirements of the role you wish to fill, as well as the action taken by you to minimise and control such risks.
  5. In the event that any relevant information changes following the submission of that information to us, you shall inform us Immediately, supplying appropriate updated information.
  6. You shall comply with any and all relevant industry codes of practice.
  7. If shall be your responsibility to provide suitable Public and Employer's Liability Insurance cover for the Talent during the Project.

19. Fee Day/s


  1. You pay us for any additional services provided by us that are nit specified in the Booking Confirmation or elsewhere in these Terms and conditions in accordance with our relevant rates or price lists at the time of the performance or such other prices as may be agreed between the Parties. Any charged for additional services will be supplemental to Fees or other expenses.
  2. In the event that we incur an expenses prior to payment of our Fees, subject to you prior written approval, these shall be added to you invoice.
  3. In the event that Talent incurs any reasonable expenses including, but not limited to, travel you shall cover such expenses and shall be invoiced for the same.
  4. You shall pay the Fees and other costs and expenses under sub-Clause with in 30 days of receiving an invoice for the same provided the due date for payment does not fall prior to the provision of the Services.
  5. We reserve the right to charge interest at the rate of 8% above the Bank of England base rate of interest per annum on any invoiced sums that remain unpaid by you from the due date to the date of payment plus an administration charge of £40 for amounts under £1000 and £70 for amounts in excess of £1000.

20. VAT / Expenses


VAT will be added to the invoice where appropriate together with any mutually agreed expenses.


21. Credits


The client agrees to include a credit on the form of the name social media @ handles and Full Names Youtube of “The Talent" and “Agency” there a credit is applied.


22. Direct Contact


You shall not endeavour to contact the Talent directly or by any other source expect via us. Neither you nor anyone associated with you other than us shall solicit any business with the Talent or any associated with the Talent.


23. Law and Jurisdiction


  1. These Terms and Conditions (including any non-contractual matters and obligations arising therefrom or associated therewith) shall be governed by, and construed in accordance with, the laws of England and Wales.
  2. Any dispute, controversy, proceedings or claim between the Parties relating to these Terms and Conditions (including any non-contractual matters and obligations arising therefrom or associated therewith) shall fall within the jurisdiction of the courts of England and Wales.
